Court Halts Restrictions on Minnesota Federal Agents

The 8th U.S. Circuit Court of Appeals has temporarily lifted a lower court injunction that restricted Immigration and Customs Enforcement (ICE) agents and other federal officers from using certain tactics against protesters in Minnesota. This decision allows agents to resume full operational flexibility during ongoing immigration enforcement actions in the state while the full appeal proceeds.

U.S. District Judge Katherine Menendez issued the preliminary injunction last Friday, barring federal agents from arresting or detaining individuals engaged in peaceful, non-obstructive protest activity. The order also prohibited the use of pepper spray, tear gas, or similar non-lethal crowd control tools against peaceful demonstrators and observers, as well as stopping vehicles tailing agents unless there was reasonable suspicion of forcible obstruction.

Judge Menendez ruled that these measures addressed a “chilling effect” on First Amendment rights amid heightened tensions in Minneapolis and surrounding areas.

The Trump administration quickly appealed, arguing that the restrictions hampered officers’ ability to protect themselves and the public in volatile situations. On Wednesday, the 8th Circuit granted an administrative stay, pausing the district court’s limits. The appeals court issued a brief, unsigned order siding with the Department of Homeland Security (DHS), allowing ICE and related federal forces to operate without the imposed constraints during review of a potential longer-term stay.
